The IRS recently granted Innocent Spouse Relief to one of our Boca Raton clients. In addition to receiving tax relief from back taxes she received a refund of a previous levy.
If the IRS is attempting to collect outstanding back taxes from you as a result of you filing a joint return with a former spouse you may be able to find tax relief using the innocent spouse rules.
If you owe IRS back taxes as a result of filing a joint return with your spouse or former spouse(referred to as “spouse” in the remainder of this discussion), the IRS may grant you equitable relief from your joint tax liability.
When you file a joint income tax return, the law makes both you and your spouse responsible for the entire tax liability. If one of the spouses who signs the joint tax return does not believe he or she should be liable for the full amount of the taxes, that spouse may seek relief from liability under the innocent spouse rules.
